Terms and Conditions

1. Your Use of the Services

Fuel Friendly LLC grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for their intended purposes subject to your compliance with these Terms and any other Fuel Friendly LLC policies. You may not copy, modify, distribute, sell, or lease any part of the Services, reverse engineer or attempt to extract the source code, scrape or data mine the Services, frame any part of the Services, or interfere with or disrupt the Services.

You further agree that you will not use the Services or any information or output derived from the Services to directly or indirectly create, train, test, or improve any machine learning, large language, or artificial intelligence model, or similar or competing product, service, or technology — including for research, open source, or non-commercial use.

User Content

You retain all rights in content you upload or submit and are solely responsible for it. You represent and warrant that you own it or are authorized to grant Fuel Friendly LLC the rights described in these Terms, and are liable if your content infringes any third party's rights. You grant Fuel Friendly LLC a non-exclusive, royalty-free, worldwide, transferable, sublicensable, perpetual license to use, store, display, reproduce, modify, create derivative works from, and distribute your content, and to use it to train, test, or enhance machine learning algorithms. Fuel Friendly LLC may remove any submitted content at its sole discretion.

Software and Accounts

Downloadable software may update itself automatically, and some components may be governed by open source licenses that control over these Terms where applicable. You must be of legal age to form a binding contract, and if acting for a business, must have authority to bind it. You are responsible for all conduct and transactions on your account and must keep your credentials secure. You must comply with applicable laws and community guidelines, and treat Third Party Providers, personnel, and support staff with respect. Fuel Friendly LLC reserves the right to decline orders, refuse delivery, terminate or restrict account access, and cancel orders at any time in its sole discretion, and may periodically offer incentives such as trial memberships, credits, or promo codes.

Fuel Friendly LLC may introduce, change, or remove features at any time without notice. Any feedback you provide may be used by Fuel Friendly LLC for any purpose, without payment to you. Cancellation, refund, or return requests should be made through your account or the Help Center; once shopping or delivery has begun, rescheduling or cancellation may no longer be possible, and fees may apply with no refund for already-purchased items. If fraud, tampering, or abuse is suspected, Fuel Friendly LLC reserves the right to cancel orders, decline or reverse refunds, charge your card on file, or revoke incentives.

2. Fuel Friendly LLC Communications

By creating an account, you agree to accept communications from Fuel Friendly LLC or Third Party Providers via email, text message, calls, and push notifications — including those generated by automatic telephone dialing systems or prerecorded messages. Message and data rates may apply. You may opt out of promotional communications anytime in your Account Settings, via the unsubscribe mechanism in a message, or by replying "STOP" to text messages.

If you order a prescription drug product, inquiries must be conducted via telephone, and a pharmacy or Fuel Friendly LLC may send unencrypted SMS or push notifications relating to your order, which carries some risk of interception by an unintended third party. By ordering a prescription product, you disclaim liability and waive any related claim against Fuel Friendly LLC, its affiliates, and Third Party Providers.

3. Coupons, Promotions and Credits

Coupons

Coupons are available for a limited time, subject to restrictions and to the relevant offeror's terms, and may change, be cancelled, or expire at any time. They apply only to qualifying items in your cart while still in effect, cannot be combined with other promotions or rebates, and you are responsible for any applicable tax or levy related to their use. Sales tax may be charged on the undiscounted price; if you return an item purchased with a coupon, the coupon's value is subtracted from your return credit. Coupons may not be sold, copied, modified, or transferred, have no cash value, are typically limited to one per user, and are void where prohibited.

Credits

Fuel Friendly LLC may modify a Credit's expiration date with 30 days' email notice, and reserves the right to cap your account's total Credit balance at $1,500, or Credits added in a single day at $2,000. Credits may be restricted from covering alcohol, prescriptions, fees, taxes, or tips, may not apply alongside a Coupon or other credit type, and have no cash value.

5. Fuel Friendly LLC Gift Cards

Fuel Friendly LLC offers currency-denominated digital and physical gift cards redeemable for eligible goods and services on Fuel Friendly LLC's website, mobile applications, and certain retailer white-label sites powered by Fuel Friendly LLC. Purchasing or redeeming a Gift Card means you agree to the separate Terms & Conditions for Fuel Friendly LLC Gift Cards, in addition to these Terms. Gift Cards and Credits generally cannot pay for the Fuel Friendly LLC+ subscription fee, unless you use a dedicated Fuel Friendly LLC+ or Express Gift Card.

6. Retailer Memberships

Certain Retailers may allow you to purchase memberships through the Services. If you do, you understand you are purchasing directly from the Retailer, will be billed separately by them, and that the Retailer's own terms and conditions apply. Contact the Retailer directly for questions about your membership or account.

7. Transactions Involving Alcohol

Alcohol may be available in some locations and from certain Retailers. You must comply with all applicable laws and be of legal drinking age — 21 or older in the United States; 18 or older in Alberta, Manitoba, and Quebec; and 19 or older in all other Canadian provinces. Upon delivery, the recipient must provide valid government-issued ID (which may be scanned, with a signature possibly required) and must not be intoxicated. You agree not to purchase alcohol with intent to resell or provide it to anyone underage. If valid ID cannot be presented, or if legal requirements are not met, your order — or the alcohol portion of it — may be cancelled. Special requests or substitutions for alcohol are not honored.

Hawaii residents acknowledge that it is illegal for a person under 21 to purchase or consume liquor, to use false or another person's identification to obtain liquor, or to purchase liquor for a person under 21 (Sections 281-78 & 101.5, Hawaii Revised Statutes). Alcohol delivered within Ontario and Alberta is delivered by Maplebear Delivery Canada Inc.

8. Delivery of Prescription Drug Products (Fuel Friendly LLC Rx)

In certain areas, you may order prescription drug products through Fuel Friendly LLC Rx. Fuel Friendly LLC is not a pharmacy, makes no recommendations as to which pharmacy to use, and is not responsible for the quality of prescription products or pharmacy services — contact the pharmacy directly with any issues. Upon delivery, the recipient must provide valid government-issued ID (which may be scanned) and indicate their relationship to you if they are not you. Prescription products must not be resold or transferred to anyone other than the person for whom they were prescribed.

No pharmacy-patient or physician-patient relationship is formed between you and Fuel Friendly LLC; consult your own healthcare professional or pharmacist for health-related issues. Ordering a prescription for a child or other household member means you intend to transfer, not personally consume, the medication.

If you are having a medical emergency, call 911 or contact your local emergency assistance service immediately.

9. Transactions Involving Other Restricted Products

You may have the option to order other restricted or age-restricted products in some locations and from certain Retailers, and must comply with all applicable laws. If an item requires delivery certification, the recipient must provide valid government-issued ID, which may be scanned by the Third Party Provider. You must be of legal age for the products ordered, and agree they have not been purchased with intent to resell or provide to an underage person. If legal requirements for delivery are not met, the restricted portion of your order may be cancelled. Special requests or substitutions for restricted products are not honored.

10. SNAP/EBT

Fuel Friendly LLC allows U.S. customers to pay for SNAP-eligible items from select retailers using a valid EBT card. By providing your EBT information, you represent that you are authorized to use it, and that the Services may be suspended or cancelled if the payment information cannot be verified. SNAP-eligible items are determined by the U.S. Department of Agriculture. A credit or debit card must also be linked to your account to cover fees, taxes, tips, and non-EBT items — Fuel Friendly LLC currently cannot accept EBT cash.

11. Third-Party Products and Content

Fuel Friendly LLC does not assume responsibility for products, content, services, advertisements, or information provided by third parties through the Services, nor for your interactions with any Third Party Provider or Retailer. Fuel Friendly LLC does not warrant that any product information — including results from AI-powered generative experiences — is accurate, complete, reliable, current, or error-free. Health, wellness, and nutritional information is provided for informational purposes only and is not a substitute for advice from a qualified healthcare provider.

Search results, including those generated by AI, may vary between users and over time, and Fuel Friendly LLC does not guarantee that AI-generated material is free of third-party infringement in any subsequent use you make of it. Your purchase, use, or engagement with any third-party product, service, or Provider is at your own risk, and Fuel Friendly LLC has no related liability.

12. Gifts and Orders on Behalf of Third Parties

12.1 Communications by Fuel Friendly LLC

If you provide a Recipient's contact information, you represent that you have obtained their consent to share it with Fuel Friendly LLC for receiving communications, including those generated by automatic dialing systems or prerecorded messages. Fuel Friendly LLC is not liable for delayed or undelivered mobile messages.

12.2 Sharing Recipient Data

If you provide Recipient data — including contact information, your relationship to the Recipient, food assistance or benefits information, or personal preferences — you represent that you have obtained the Recipient's consent to share this information, including any authorizations required so that Fuel Friendly LLC does not become a HIPAA Business Associate. Fuel Friendly LLC has no liability for your, or any third party's, failure to obtain appropriate consent, and will use Recipient data in the ordinary course of its business.

13. In-Store Features

You may have access to features intended for use while shopping in a Retailer's physical store, including In-Store Mode (browsing in-store items via the Services) and Scan & Pay (scanning and paying for items on your mobile device while in-store). Your use of these features may also be subject to the Retailer's own policies covering hours, conduct, refunds, returns, and loyalty programs.

Retailers set and may update In-Store Feature prices in real time, which may not immediately reflect on your device — you must alert store staff to any discrepancy. Some in-store-only offers, clearance pricing, or items may not be available on In-Store Features.

While using Scan & Pay, you must ensure items are correctly scanned and weighed, pay for all products before leaving the store, and comply with applicable laws. Report any scanning or checkout issues to a store employee, and complete your transaction at a register if payment cannot be processed. You must exit through the designated Scan & Pay checkout or exit area as instructed. Retailer personnel may audit your cart, including re-scanning items — if a re-scan differs from your scan, the re-scan is decisive. Repeated scanning errors may lead to suspension or termination of Scan & Pay or your Service access.

Returns or refunds for in-store purchases follow the applicable Retailer's own policies. Fuel Friendly LLC and its licensors retain ownership of the Services and any images scanned through the application, which may be retained to improve the Services.

14. Service Provided As-Is and Release of Claims

The Services are provided "as is" and "as available." Fuel Friendly LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and makes no guarantee regarding the reliability, timeliness, or availability of the Services, Third Party Providers, or Retailer goods, or that the Services will be uninterrupted or error-free. Fuel Friendly LLC does not guarantee the Services are free of viruses or malware, and is not responsible for economic costs relating to your use of the Services.

Fuel Friendly LLC is not responsible for the fitness or conduct of any Third Party Provider, or for any claim, injury, or damage arising from their acts or omissions. If you have a dispute with a Third Party Provider, you agree to release Fuel Friendly LLC (and its subsidiaries, affiliates, officers, directors, employees, agents, and retail partners) from related claims and damages of every kind. Some jurisdictions do not allow the exclusion of certain warranties, so these exclusions may not apply to you, and you may have other legal rights.

15. Limitation of Liability

Fuel Friendly LLC (including its subsidiaries, affiliates, officers, employees, retail partners, licensors, and suppliers) will not be liable for any incidental, special, punitive, consequential, or indirect damages — including data loss, service interruption, or the cost of substitute services — arising from the Services or these Terms, even if advised of the possibility of such damages.

Fuel Friendly LLC will also not be liable for indirect, special, punitive, incidental, exemplary, or consequential damages — including physical injury, death, or emotional distress — arising from your use of the Services, Third Party Provider services, or products delivered to you.

Aggregate liability for all claims relating to the Services is limited to the greater of $100 or the amount you paid Fuel Friendly LLC in the past 12 months. Some jurisdictions do not allow these limitations, so they may not apply to you, and you may have other legal rights.

16. Indemnification

You agree to defend, indemnify, and hold harmless Fuel Friendly LLC and its officers, directors, employees, agents, shareholders, subsidiaries, affiliates, and retail partners from losses, claims, damages, and expenses (including attorneys' fees) arising from: your unauthorized use of the Services or breach of these Terms; a third party's access to or use of the Services through your account; any dispute between you and a third party, including a Retailer or Third Party Provider; or your subsequent use of content created by AI-powered generative experiences.

17. Dispute Resolution & Arbitration Agreement

17.1 Overview

This section provides a two-part dispute resolution process: an informal resolution process directly with Fuel Friendly LLC, and, if necessary, binding arbitration administered by the American Arbitration Association ("AAA") or ADR Services Inc., depending on where you reside. Either party may instead pursue disputes in small claims court.

17.2 Mandatory Informal Dispute Resolution

Before initiating formal proceedings, you and Fuel Friendly LLC agree to attempt to resolve disputes amicably. For any dispute you initiate, you must send a personally signed written notice including your name, account email, a description of the dispute with transaction details, and the specific relief sought, to:

Fuel Friendly LLC will send its own notice to the most recent delivery address on your account. Each party has 60 days to respond before an arbitration or other proceeding may be initiated, and the statute of limitations is tolled during that period.

17.3 Arbitration Agreement for United States Residents

If a dispute cannot be resolved informally, you and Fuel Friendly LLC agree to resolve any claim through binding arbitration rather than in court — including claims about these Terms, your access to or use of the Services, any transactions, your relationship with Fuel Friendly LLC, and Third Party Disputes. This applies even to claims that arose or were asserted before the effective date of these Terms.

17.4 Application to Third Parties

This Arbitration Agreement also covers disputes involving Retailers, Third Party Providers, vendors, payment processors, fraud-prevention or advertising partners, and your spouse, heirs, third-party beneficiaries, or assigns, where the claims arise from your use of the Services or your account.

17.5 Exceptions

Both parties retain the right to bring individual claims in small claims court, and to seek injunctive relief in court to prevent infringement of intellectual property rights. Disputes about small claims court eligibility are resolved by that court, not an arbitrator.

17.6 Jury Trial Waiver

By entering into these Terms, you and Fuel Friendly LLC each waive the right to a trial by jury for any claim within the scope of this Arbitration Agreement.

17.7 Class, Collective, and Representative Action Waiver

You and Fuel Friendly LLC each waive the right to bring or participate in any class, collective, or representative action. Arbitration will be conducted only on an individual basis, and an arbitrator may not consolidate claims or award relief affecting other users.

17.8 Arbitration Rules and Governing Law

The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement. Arbitration is generally administered by the AAA under its Consumer Arbitration Rules, held in the county where you live or use the Services. Claims of $10,000 or less are decided on documents alone unless a hearing is deemed necessary; larger claims follow AAA hearing rules. Each party generally bears its own arbitration fees, though a party asserting a frivolous or bad-faith claim may be ordered to pay the other's fees and costs.

17.9 Opt-Out of Mandatory Arbitration

You may reject this Arbitration Agreement within 30 days of first accepting these Terms by emailing Fuel Friendly LLC with your name, account email, and a statement of intent to opt out. Opting out does not affect any other part of these Terms.

17.10 Changes to Agreement to Arbitrate

If Fuel Friendly LLC changes this Section 17, you may reject the change by written notice within 30 days of its effective date. Rejecting a new change does not undo your prior agreement to arbitrate existing disputes.

17.11 Severance of Arbitration Agreement

If any part of this Arbitration Agreement is found void or unenforceable, only that part is severed, and the remainder stays in force. If the class action waiver is found unenforceable specifically as to public injunctive relief, only that claim is litigated in court, stayed pending the outcome of any arbitration.

17.12 Survival of Arbitration Agreement

This Arbitration Agreement survives termination of these Terms or your access to the Services, and continues to apply even after you or Fuel Friendly LLC close your account.

18. Termination

You may stop using the Services at any time without notice. Fuel Friendly LLC may similarly terminate your access, or any user's access, or stop offering all or part of the Services at any time without notice. Upon termination, Sections 1 and 4 through 22 of these Terms survive and continue to apply.

19. Controlling Law

These Terms are governed by the laws of the State of Tennessee for U.S. residents, without regard to conflict-of-laws principles, except the Arbitration Agreement, which is governed as set out in Section 17. Any claims not subject to Section 17 must be brought exclusively in the federal or state courts of Tipton County, Tennessee, and you consent to their jurisdiction.

20. Entire Agreement & Severability

These Terms, together with any amendments or additional agreements, constitute the entire agreement between you and Fuel Friendly LLC regarding the Services. If any provision is found invalid by a court of competent jurisdiction, that provision will be limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. No Waiver

Fuel Friendly LLC's failure to monitor or enforce any provision of these Terms does not waive its right to do so in the future, with respect to that provision, any other provision, or these Terms as a whole.

22. Assignment

You may not assign any of your rights, licenses, or obligations under these Terms, and any attempted assignment by you is void. Fuel Friendly LLC may assign its rights, licenses, and obligations under these Terms without limitation.

23. Changes to the Terms

Fuel Friendly LLC may change these Terms from time to time and will post the current version on its website. If a revision is material, Fuel Friendly LLC will notify you, for example by email or an in-Service notification. Changes will not apply retroactively. If you disagree with modified Terms, you should discontinue your use of the Services.

24. Intellectual Property Policy

Use of the Services does not grant you any right or license to frame, use, or reproduce Fuel Friendly LLC's copyrighted material, trademarks, service marks, or other proprietary rights, except as expressly permitted in writing. Fuel Friendly LLC follows a copyright and trademark policy in accordance with the Digital Millennium Copyright Act and other applicable laws, and reserves the right to terminate infringing users.

To report copyright infringement, send a written notice to the Copyright Agent including: a signature of the copyright owner or authorized representative; a description and location of the claimed infringing material; your complete contact information; a good-faith statement that the disputed use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the owner's behalf.

Trademark infringement notices may be sent to the same address, including a description of the trademark, registration number, and details of the allegedly infringing product and its location.
